NEHF Contract

In consideration of Northeast Health & Fitness allowing me to be a member and permitting me to use its facilities and equipment, I agree to the following:

In attending the Northeast Health & Fitness Club(s) and using its facilities and equipment, I agree that I am doing so at my own risk. The Northeast Health & Fitness Club(s) shall not be liable for any damages arising from personal injuries sustained by me on the premises. I assume full responsibility for any injuries which may occur to me on the premises of the Club(s) and release and discharge Northeast Health & Fitness Club(s), its owners, its employees and its agents from any and all claims resulting from my use of the facilities and equipment of the club. I represent that I am in good physical condition and that I have no disability or impairment preventing me from engaging in active or passive exercise.

Lack of use does not relieve member of past, present or future monetary obligations. Refunds will not be given for lack of use. Memberships cannot be frozen unless recommended and accompanied by a certified Dr’s note and/or deployed on military leave. Frozen memberships cannot be canceled. Frozen memberships will be charged a minimum monthly fee of $8.00. Frozen memberships are not applied against the 12 month minimum contractual term. Unless accompanied by a Dr’s note and/or deployed on military leave – Frozen memberships will be for an initial term of 2 months and will automatically revert to full membership monthly rate after frozen term has concluded. Accounts 60 days past due will be terminated and sent to a third party collection agency.

Cancellations must be done in writing either in person or by certified mail, return receipt requested. Cancelled memberships will end upon final day during last month billed. All cancellations must be received 30 days prior to final requested charge date.

It is further understood that breaking any of the posted club rules and regulations will result in membership termination at the discretion of management.

Annual Fee: An annual fee of $39 will be added to the scheduled monthly payment in March for all members. This fee occurs regardless of use, frozen status and/or pending cancellation.

A $25 service fee will be charged for all transactions returned uncollectable. Changes in billing account information must be received in writing at least 10 days prior to billing date in order to prevent service fees. A $3.00 transaction fee will be charged monthly and added to the monthly payment for all memberships billed via credit and/or debit card. A $5 fee per offense will automatically be charged for any person registered for a class who no shows without canceling within 4 hours of class start time.

This agreement is for a period of not less than 12 months and cannot be terminated or altered until the initial 12 month term has concluded. Upon fulfillment of the original 12 month term, membership billing will continue until member cancels monthly payment by method outlined in this agreement.

Customers Right of Cancellation: You may cancel this contract without penalty or further obligation causing a written notice of your cancellation to be delivered in person or postmarked by certified or registered United States mail within three (3) business days of the date of this contract or the date of your receipt to the address specified in the contract.
